Kaien API Terms of Service

What you are accepting

These Terms govern your access to and use of Kaien API services provided through https://kaienapi.com, any successor or renamed site, and related subdomains.

Please read these Terms together with the Privacy Policy, product pages, pricing pages, API documentation, and service rules before you register, sign in, top up, create an API key, or use the service.

When you click to accept, register, sign in, top up, purchase, create an API key, call an API, or continue using the service, you are confirming that you have read, understood, and agreed to these Terms. If you do not agree, do not register or use the service.

If you have a separate written agreement with Kaien API and it conflicts with these Terms, the written agreement controls that conflicting part. Anything not covered by that agreement is still governed by these Terms and the online rules you accept.

Accounts and security

To use Kaien API, you must accept these Terms and complete the account registration process. If you are using the service for a company or organization, you confirm that you are authorized to bind that entity.

Registration details, contact information, billing information, and verification materials you submit must be true, current, and lawful. If inaccurate or unauthorized information causes a loss or dispute, you are responsible for it.

For account security, transaction security, risk control, or compliance, Kaien API may require email, phone, identity, enterprise, passkey, two-factor, or other reasonable verification.

If required verification is not completed, Kaien API may restrict or refuse sensitive actions such as top-ups, refund review, account deletion, API key viewing, API key reset, or changes to sensitive account information.

You are responsible for protecting your account, password, API keys, access tokens, verification devices, and other credentials. Actions made through your account or credentials will be treated as authorized by you unless applicable law clearly requires otherwise.

Do not transfer, lend, sell, share, rent, sublicense, or otherwise provide your account or credentials to anyone else without written consent from Kaien API. Losses caused by leakage, sharing, poor storage, or unauthorized use are your responsibility.

What the service includes

Kaien API provides AI model API access, a developer console, Playground, image generation, model information, usage logs, balance management, documentation, and related technical services. Supported models, capabilities, prices, limits, billing rules, and usage notes are based on the latest information shown on the website, console, pricing page, model page, order page, or API documentation.

Some features may have their own product rules or service agreements. You may use those features only after accepting the applicable rules.

AI output can be wrong, incomplete, unstable, outdated, inappropriate, or unsuitable for your purpose. Review and verify output yourself, especially in legal, medical, financial, safety, employment, credit, education, or other high-impact scenarios.

Kaien API does not provide legal, medical, financial, investment, professional, or compliance advice. Output from the service is not Kaien API's opinion, guarantee, or commitment.

Kaien API may change service modules, model availability, request limits, rate limits, pricing, discounts, payment methods, and technical interfaces when operations, costs, technology, compliance, risk control, or product planning require it.

Fees, top-ups, and credits

Your use of Kaien API may incur fees. The price, billing unit, model price, plan rule, usage rule, discount, promotion, quota rule, and expiration rule are based on what is shown when you purchase, top up, confirm an order, or make the actual API call.

Prepaid balance, computing credits, package benefits, coupons, trial credits, promotional credits, and other virtual service resources can only be used for designated Kaien API services. They cannot be transferred, sold, cashed out, or used outside the platform.

Unless mandatory law requires otherwise or the relevant page clearly says otherwise, a successful top-up or purchase means the virtual service resource has been delivered. Refunds are not supported for non-use, account deletion, service termination, subjective dissatisfaction, later price changes, or similar reasons.

Keep enough balance or quota before using paid services. Insufficient balance, expired quota, payment failure, abnormal transaction, chargeback, risk control, or unpaid fees may lead to restriction, suspension, or termination of service.

The validity period of balance or credits follows the product page, top-up page, promotion page, order page, or console display. If no special period is shown, the default validity period is one year from arrival in your account. Expired balance or credits become invalid without extension, compensation, or refund unless mandatory law says otherwise.

If a top-up or purchase does not arrive because of a system issue, submit payment proof, account information, and relevant screenshots promptly. After verification, Kaien API may correct or reissue the balance or credits.

If you need an invoice, submit true and complete invoice information under platform rules. Invoice type, title, content, application deadline, and processing time depend on the platform rules and actual support available.

API use, data, and logs

Use Kaien API only for lawful and compliant needs. If your application involves personal information, sensitive data, non-public information, enterprise data, or regulated content, you must obtain the required authorization and give clear, lawful notice to the relevant people or organizations.

You are responsible for your applications, websites, clients, plugins, automated scripts, workflows, downstream users, and business scenarios. Your use must comply with applicable law, data protection rules, cybersecurity requirements, and content governance duties.

Kaien API is an API access and technical service, not a permanent storage service. Logs, request records, generated content records, and debugging records may be kept for a limited time for billing, troubleshooting, security, audit, and compliance, and may be cleared under system policy.

Back up the request records, response records, business data, invoices, payment proof, and other materials you need for business operations, accounting, audit, disputes, or compliance.

Without written consent, you may not resell, redistribute, sublicense, rent, lend, export, transfer, repackage, or provide Kaien API services or results to third parties outside the authorized scenario.

Do not bypass billing, security checks, or access controls; overload the service; scrape non-public data; reverse engineer the service; interfere with platform stability; or use the service in a way that harms Kaien API or other users.

Prohibited use

Do not use Kaien API to create, upload, process, copy, publish, transmit, or assist content or conduct that violates law, regulation, public order, good morals, or third-party rights.

Prohibited use includes activity involving national security harms, state secrets, subversion, separatism, terrorism, extremism, ethnic hatred or discrimination, rumors that disrupt public order, superstition, obscenity, pornography, gambling, violence, homicide, terror, or criminal instruction.

You may not use the service to insult, defame, harass, threaten, impersonate, dox, or maliciously attack others, or to infringe privacy, reputation, portrait rights, intellectual property, trade secrets, personal information rights, or other lawful rights.

You may not use the service to develop, generate, distribute, or assist malware, viruses, credential theft, phishing, vulnerability exploitation, unauthorized access, data scraping, spam, fraud, money laundering, pyramid schemes, illegal fundraising, illegal financial activity, or similar harmful activity.

Do not use the service as the sole or main basis for automated decisions in medical, financial, legal, employment, education, credit, insurance, public service, or other sensitive scenarios unless you have the required notice, authorization, review, human oversight, and legal basis.

If Kaien API discovers or reasonably suspects a violation, or receives a complaint, regulatory notice, judicial request, or serious public report, it may take measures such as warnings, request rejection, content blocking, service restriction, account freezing, service termination, evidence preservation, or reports to competent authorities.

Account deletion and termination

If you no longer need Kaien API, you may request account deletion through platform instructions or customer support. Kaien API may review the request within a reasonable period.

Before deletion, Kaien API may check whether the account has unfinished orders, unresolved disputes, unpaid fees, recent abnormal security actions, suspicious transactions, or unresolved risk events. If an issue exists, deletion may be postponed or refused until it is resolved.

Deleted accounts may not be recoverable. Unless mandatory law provides otherwise, unused balance, credits, package benefits, coupons, trial benefits, promotional benefits, and other virtual rights are treated as voluntarily waived when the account is deleted.

After deletion, Kaien API will delete or anonymize account information according to law and platform rules. Transaction records, service records, security logs, and other required records may still be retained for legal, audit, dispute, or compliance needs.

If service is suspended or terminated because of your breach, unpaid fees, abnormal transaction, attack, abuse, or account deletion, Kaien API is not required to refund unused balance or compensate virtual rights unless mandatory law says otherwise.

Intellectual property

The Kaien API website, console, documentation, page design, product names, logos, software, interface design, technical materials, text, graphics, images, audio, video, and other materials are protected by intellectual property law and belong to Kaien API or the relevant rights holders.

Without written permission from Kaien API or the rights holder, you may not copy, modify, distribute, publicly display, mirror, scrape, reverse engineer, decompile, disassemble, lease, sell, or create derivative works from those materials.

You keep the rights you lawfully have in content you submit or generate through the service, subject to third-party rights and applicable law. You allow Kaien API to process that content only as needed to provide, maintain, protect, improve, troubleshoot, bill, audit, and support the service.

Your input, uploaded files, business data, and use of generated output must not infringe third-party rights. Disputes, claims, losses, or liabilities caused by your content or use are your responsibility.

Disclaimers and liability limits

Kaien API will take reasonable steps to keep the service safe and stable, but it cannot guarantee uninterrupted operation, error-free results, complete security, permanent availability, or fitness for every scenario.

Service unavailability, delay, degraded quality, data loss, output error, or other impact caused by your operation, device, software, network, third-party service, payment service, model capability, regulatory requirement, maintenance, cyberattack, virus, network congestion, force majeure, or events beyond Kaien API's reasonable control is not a breach by Kaien API.

Kaien API is not responsible for losses suffered by your customers, end users, partners, or other third parties who use or rely on the service through you. You are responsible for your downstream users and business use.

To the maximum extent permitted by law, Kaien API's total liability for claims related to the service is capped at the service fees you actually paid for the disputed service during the twelve months before the dispute arose.

Disclaimers, liability limits, intellectual property terms, payment obligations, compliance obligations, and dispute resolution terms continue to apply after suspension, termination, or account deletion.

Notice, governing law, and disputes

Kaien API may send notices through website announcements, console notifications, in-site messages, email, SMS, customer support messages, documentation updates, or other reasonable methods. A notice is treated as delivered when sent, published, or displayed.

Keep your contact information valid and review platform notices in time. Losses caused by unread notices or invalid contact information are your responsibility.

Kaien API may update these Terms for legal, regulatory, product, business, security, or operational reasons. Updated Terms will be published on the website, console, or relevant page. Continued use after publication means you accept the updated Terms.

These Terms are governed by the laws of the People's Republic of China. Disputes related to these Terms or Kaien API services should first be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with a competent people's court where the Kaien API service provider is located.

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision is severed only to the necessary extent and does not affect the remaining provisions.
